Terms and conditions

These terms and conditions ("Terms and Conditions") set out the legal terms that apply to your (the “User”) use of our website http://www.e-caravelle.com (the "Website") and the other services that we provide (the "Services").

Please read these Terms and Conditions carefully and make sure that you understand them, before using the Services. Please note that by using the Services, the Website or if you order products, you indicate your acceptance of these Terms and Conditions.

These Terms and Conditions are written in English and English prevails on any other translations.

We may modify the Terms and Conditions from time to time. Please read the Terms and Conditions and check back often. If you do not agree to any change to the Terms and Conditions, then you must immediately stop using the Website.

1. ABOUT US

Caravelle is a trading name of Caravelle International Limited, a company registered in Hong Kong under the number 2334719 with a registered office at 151 Gloucester Road, 14F/1403, Wan Chai, Hong Kong.

We provide the Services to you through the Website (see section 2 below). We select and purchase the products displayed on our Website from our Partners and are authorized by these Partners to sell it. All our Partners are authorized dealers with official trademarks of the brands and products displayed on our Website. 

When you purchase products using the Website, you are purchasing them from us.

Further details about the products, our Partners and the contract between you and us in relation to your purchase of the products are set out in sections 5, 6 and 7 below.

2. OUR SERVICES

The Services we offer allow you to search through the Website and purchase products from different brands. We are also in charge of arranging delivery of the products from our Partners and providing you with customer service assistance. 

3. ELIGIBILITY TO PURCHASE

To use the Services from the Website you must be over 18 years of age. You will also need to register and provide personal information related to your identity, contact details, payment details, billing and other information which may requested on the Website. When you provide information about yourself, payment and billing, it needs to be true, accurate, current, complete in all respects and to refer to you.

Regarding your registration information, if any change occurs, please update immediately your profile on the Website or send us an email at the following address: info@e-caravelle.com.

The account password you set should be kept safe and unique. You must inform us immediately of any breach of security or unauthorized use of your account at the following address: info@e-caravelle.com

The Website is available only to individuals and others who meet Caravelle terms of eligibility set herein, who have been issued a valid credit/debit card by a bank acceptable to Caravelle, whose applications are acceptable to Caravelle and who have authorized Caravelle to process a charge or charges on their credit/debit card in the amount of the total purchase price for the products they purchase. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, Caravelle reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

By making an offer to purchase products on our Website you expressly authorize us to perform credit checks and where Caravelle feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports, to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit/payment reference or fraud prevention agency, which may keep a record of that information.

Please note that we may disclose your personal data:

To other companies within our group/business for the purpose of the Service;

If we sell our business;

To agents and service providers;

In cases where we are required by law to pass on information or if we believe action is necessary for fraud, cybercrime or to protect the website, rights, personal safety of persons.

4. LIABILITY

If, in providing the Services to you, we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started using the Services.

We do not in any way exclude or limit our liability for death or personal injury arising by our negligence, fraudulent misrepresentation by us or our employees and any other liability which cannot be limited by law.

In any case, we shall not be responsible for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website or use of the Service, any information by you, or material information transmitted over our system directly by you. In particular, neither the website owner nor any third party or data or content provider shall be liable in any way to you or to any other person, for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of information or the transmission thereof, or for any actions taken in reliance of the information provided by you.

5. PRODUCTS

We attempt to be as accurate as possible in the description of the products. However, as the descriptions are based on information provided to us by our Partners, we cannot guarantee that any descriptions are totally accurate, complete, reliable or error-free. The images of the products on the Website are for illustrative purposes only. Although we attempt to display the colors accurately, we cannot guarantee that your computer's display of the colors accurately reflects the color of the products.We do not offer flawed products or products of lower quality than the corresponding market standards for sale on the Website. Furthermore, all our products are authentic with official trademarks and certificate from corresponding brands. Finally, our Partners are performing quality checks before the products are entrusted to the chosen courier company.  If products you have ordered are not as described, flawed or of a lower quality than the corresponding market standards, we will liaise with our Partner to perform investigations and you can return them to us if the defect is confirmed. You will then receive a full refund of the price of the defective product, any applicable delivery charges and any reasonable costs you incur in returning the products (we will advise you whether the products will be collected from you or whether you need to arrange for them to be returned). Please see section 8 below for details about or Returns and Exchanges policy.

As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms and Conditions will affect these legal rights.

The products sold by us and shipped from our Partner are supplied for your domestic and private use only. You agree that you will not use the products for any commercial, business or re-sale purposes. Neither we nor our Partners have any liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

6. ORDERS, PRICES AND PAYMENT

Please refer to the “Checkout process” section of our FAQ page to see how to place an order.  By completing the check-out process and placing an order, you are purchasing products from us and subject to these Terms and Conditions. All orders are subject to acceptance, availability and confirmation of the order price.

To order products you must possess a valid credit or debit card (please see section (c) below for details of acceptable payment methods), be an authorized user of the credit or debit card used to place your order and that there are sufficient funds in the account to cover the cost of your order. In a credit card transaction, you must use your own credit card. Caravelle will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the duty to 'prove otherwise' shall be exclusively on the user.

The Website allows you to check your order and correct any errors before sending it. Please take the time to read and check your order at each page of the order process as you are responsible for ensuring that the information you provide is accurate (for example, the correct products, quantities, size, colour, etc.).

Caravelle will store a record of your transactions in order to support you more efficiently in case of questions or issues and to ensure that information we are sending to you are correct.

(a) Our Relationship

When you place an order, you shall receive 2 confirmation emails:

-       Firstly an acknowledgement email confirming the receipt of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.

-       A second email confirming that the goods have been dispatched.

Unless you cancel your order, acceptance of your order and completion of the contract between you and Caravelle will be completed when we email you to confirm that the goods have been dispatched.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms and Conditions.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Website whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and Caravelle as a result of the Terms and Conditions or your use of this Website. You agree that you may not and will not hold yourself out as a representative, agent, or employee of Caravelle, and we shall not be liable for any representation, act, or omission on your part.

(b) Pricing and availability

The basis price of our products is in Euro (EUR€). Our Website allows you to also consult  equivalences in other currencies such as US Dollars (USD $),  Chinese Yuan (CNY), Japanese Yen (JPY) or Hong Kong Dollars (HKD)... Payments are invoiced in US Dollars (USD $). To ensure that the most accurate and convenient pricing is displayed for you, we recommend that you click on the link at the top of our website and select your currency from the list of currencies. We also recommend you to contact your bank to obtain detailed information about multiple currencies transactions and rates if it applies to your order.  

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible by email or by phone if this contact information is available. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

Taxes and duties are calculated according to your shipping destination and displayed on the Order Review page. Apart from exception or specific restrictions, all countries are shipped to on a DDP (Delivery Duty Paid) basis, which means that all relevant import taxes and duties will be included in the product price.

Delivery costs are not included in the prices and will be charged in addition. The delivery costs will vary depending on the products that you have ordered and your delivery address. The delivery costs applicable to your order will be clearly displayed on the Order Review page before you place your order.

Please note that if you return an item and if the return is valid and accepted by us, the import duties and delivery costs will be refunded. 

(c) Payment

Payments can be made by Visa, MasterCard, American Express, China UnionPay,  Alipay and any other methods which may be clearly advertised on the Website from time to time.

If you paid by debit card, payment will usually be taken immediately. If you paid by credit card, payment will usually be taken once your order is approved and ready for shipping. Please be aware that your bank or card issuer may reserve the money, meaning that you can't use it for a short period. If you cancel your order before it is processed, we will simply cancel the transaction and there will be no need to process a refund.

When you submit your order, standard validation checks and authorization on credit/debit card holders will be performed by the relevant card issuer. If the issuer of your payment card refuses to authorize payment to Caravelle, we will not be liable for any delay or non-delivery. Products will not be dispatched until these validation checks and authorizations have been completed.

7. DELIVERY AND INSURANCE

We will try to ensure that your order is delivered on time but there may be circumstances where delivery is delayed because of events beyond our reasonable control. If this happens, we will try and arrange for your products to be delivered as soon as possible, but we will not be liable to you for any losses caused as a result of such delay.

Delivery times may vary depending on the availability of the products and your delivery address. Delivery times are estimates only and cannot be guaranteed. The products will be delivered to you directly by our Partners through their carrier so your order may be delivered in multiple deliveries. A tracking number will be communicated by email once the product has been dispatched in order to follow the shipping process.

If no one is available at your address to take delivery, our delivery partner will leave you a note and you will need to contact them to rearrange delivery. We do not deliver to P.O. Boxes.

You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable or responsible if you break any such laws.

Caravelle insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Caravelle, and transfer of responsibility in the same way. The goods are your responsibility from the time we deliver them to the address you gave us.

You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) we deliver the goods to you.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received.

8. RETURNS AND EXCHANGES POLICY

Goods can be returned if they are incorrect, defective or damaged when you receive it. The validation of the return and its subsequent refund will be authorized only after investigations have been performed by Caravelle.

You must submit your product return request online (section “Contact us”) or by email (customercare@e-caravelle.com) within 5 working days after you received it. Once we received your request, we will perform investigations and may ask you additional details to clarify and justify your ground. Once authorized, the product must be sent back to us within 10 working days.

Items should be returned unused and with all designer garment tags still attached. Returns that are damaged or soiled will not be accepted and will be sent back to the customer and/or a refund refused.

Where provided, belts and any designer packaging such as authenticity cards, dust bags, and leather tags should be included with your return.

Should the non-conformity be due to negligence, malpractice, imprudence by Caravelle and/or its Partners, the return would be validated and the product will be fully refunded (including all delivery costs and taxes).

Goods can also be returned without any specific ground or exchanged for another product. In that case, the same process as set above will be followed, except that if the return/exchange and the refund are accepted, the refund will not include delivery costs and taxes.

9. OUR WEBSITE

This section sets out the rules that apply to your use of the Website (whether or not you use it to order products or just to browse). By using the Website, you agree to these rules. If you do not agree to these rules, you are not permitted to use the Website and you should leave it immediately. Please also refer to our Privacy and Cookie Policy section for the use of the Website.

(a) Access to the Website

The Website is made available free of charge. You are responsible for making all arrangements necessary for you to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and Conditions, and that they comply with them.

Access to the Website is permitted on a temporary basis and it does not include any commercial use of the Website or its contents. You must not reproduce, copy and/or exploit the Website for any commercial purposes witho

You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.

You understand that you are responsible for all electronic communications and content sent from your computer to us and you must use the Website for lawful purposes only.

- In any way that breaches any applicable local, national or international law or regulation.- In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.- To send, use or reuse any material that is: (i) illegal, offensive, abusive, indecent, defamatory, obscene or menacing, and/or (ii) in breach of copyright, trademark, confidence, privacy or any other right, and/or (iii) otherwise injurious to third parties, and/or (iv) objectionable, and/or (v) which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam".

- To cause harm, annoyance, inconvenience or needless anxiety to any person.Breaching these provisions would constitute a criminal offence. We, in compliance with any enforceable law or public order, could report any such breach to the relevant law enforcement authorites and disclose your identity to them.

We would be glad that you add link(s) to the Website but you must do so in a way that is fair and legal and does not damage our reputation or take advantage of it (such as by using a link to suggest any form of association or endorsement by us). We reserve the right to withdraw linking permission at any time and, if we instruct you to remove a link to the Website, you must do so without delay.Where the Website contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources and such links should not be interpreted as an endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Please note that this means any of the content on the Website may be out-of-date at any gn time. The content on the Website is provided for general information only. We will not be liable to you or any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with: (i) use of, or inability to use, the Website; or (ii) use of or reliance on any content displayed on the Website.

Please note that we only provide the Website for domestic and private use and, as such, we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any content on it, or on any website linked to it.

We do not in any way exclude or limit our liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

any other liability which cannot be limited by law;

except if any of the above is caused directly or indirectly by your behavior or willful misconduct.

Different limitations and exclusions of liability will apply to liability arising as a result of our supply of the Services to you (as set out in section 2) and shipment of products from our Partners.

10. PRIVACY POLICY

We only use your personal information in accordance with our Privacy Policy. Please take the time to read it carefully, as it includes important information about how we collect and use your data. By using the Website, you consent to the use of your data as described in our Privacy Policy and you warrant that all data provided by you is accurate.

11. INTELECTUAL PROPERTY, SOFTWARE AND CONTENT

We are the owner or the licensee of all intellectual property rights in the Website and its content (such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software including the presentation and compilation of the same) ("Content"). The rights in the Website and the Content are protected by international copyright laws as well as by any relevant national law concerning copyright, authors' rights and database right laws. All such rights are reserved.You must not systematically extract and/or re-utilise parts of the Website or the Content. In particular, you must not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation any substantial parts of the Website. You must not create and/or publish your own database that features substantial parts of the Website (e.g. our prices and product listings) without our prior written consent.

Except where expressly stated to the contrary, all persons (including their names and images), third party trademarks and images of third party products, services and/or locations featured on the Website are in no way associated, linked or affiliated with us. Any trademarks/names featured on the Website are owned by the respective trademark owners.

12. OTHER IMPORTANT INFORMATION

Severability - Each of the sections and paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining sections and paragraphs will remain in full force and effect.

Waiver - If you breach these Terms and Conditions and we take no action, or if we delay in taking action, that does not mean that we have waived our rights and we will still be entitled to use our rights and remedies. If we do waive a breach by you, we will only do so in writing and that will not mean that we will automatically waive any later breach by you.

Governing law and jurisdiction - These Terms and Conditions are governed by Hong Kong law. The courts of Hong Kong shall have the exclusive jurisdiction over any dispute or claim relating to these Terms and Conditions.

Entire agreement - These Terms and Conditions constitute the entire agreement between you and us and they supersede any and all earlier agreements between you and us. Events outside of our control - force majeure - We and our Partners will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations to you if such failure or delay is caused by an event outside of our control.

An event outside of our control means any act or event beyond our or our Partners reasonable control such as act(s) of God, wars, terrorist attacks, embargos, riots, strikes, lock-outs, trade disputes, fires, floods, earthquakes or other natural disasters, break-down, inclement weather, interruption of transport, Government action or failure of public or private telecommunications or transport networks. If such an event takes place and it affects the performance of our or the Partner Boutiques' obligations to you: (i) we will contact you as soon as reasonably possible to notify you; and (ii) our and the Partner Boutiques' obligations to you will be suspended for the duration of the event. Where the event affects delivery of products to you, we will contact you to arrange a new delivery date after the event is over.
